Trust disputes invariably involve friction between beneficiaries and trustees, which often leads to litigation, so James Price and his team at Stewarts are frequently instructed to assist with court applications, both onshore and offshore. Price set up Stewarts’ trust and probate litigation practice more than five years ago, and has headed up the growing team since. He believes that trusts and estate litigation is only set to increase. ‘This type of work brings with it particular challenges created by events like death, divorce or family breakdown, so lawyers in this area require both emotional intelligence and technical expertise in equal measure,’ he says.
