David Draisey

Spear’s Review

David Draisey joined Hunters as a trainee in 2007 and became partner in 2018. He represents a wide range of clients on contentious matters involving wills, trusts and probate in the High Court. He also takes on residential and commercial property disputes, including those involving land ownership, and those between landlords and tenants.

A significant number of familial conflicts arise from the transfer of an estate to the next generation, he tells Spear’s. ‘It’s any number of disputes which arise in the context of running a modern estate,’ he says, adding that the transfer ‘tends to be quite a moment of friction, because landed estates are held for families in a trust structure or similar’.

Draisey advises on the restructuring of estates for tax purposes and to smooth issues ahead of succession. ‘It’s not just about solving disputes which have arisen, but it’s also about preventing them, nipping them in the bud before they’ve even become a thing. It’s protection.’

David regularly advises on both residential and commercial property disputes, including disputes over the ownership of land, disputes between landlords and tenants, adverse possession, residential possession claims, forfeiture and restrictive covenants. David is also experienced in claims for negligence against professional advisers, often related to the expertise mentioned. His clients include trustees, beneficiaries, land estate clients and City professionals, among others.
