A partner in Irwin Mitchell’s will, trust and estate disputes team, as well as its commercial litigation and dispute resolution team, James Laycock is regularly involved in cases challenging the validity of wills. These challenges are typically based on one of a number of reasons, including lack of capacity, irregularities, undue influence and fraud, as well as claims for financial provision, and Laycock acts for executors, trustees and beneficiaries.

When it comes to commercial disputes, he tells Spear’s that his particular expertise lies in disputes concerning business-to-business contracts, shareholder disputes and claims against directors, professional negligence claims and disputes relating to restrictive covenants. ‘I also have experience in intellectual property claims, property disputes and fraud cases,’ he adds.
