Guernsey-based Christian Hay is a partner and global head of the private client and trust practice group at Collas Crill. He advises on contentious trust disputes, with a focus on Guernsey trust structures or international cases with a Guernsey dimension.
A fellow of the Chartered Institute of Arbitrators, he is a keen proponent of alternative dispute resolution (ADR) as a way to resolve disputes without costly and time-consuming litigation. ADR, he explains, ‘hasn’t really taken off in Guernsey as it has in the rest of the world’, so he tries to utilise it where he can.
Hay was recently an advocate in the Bernheim v Krummenacher case, which provided guidance on the Guernsey court’s jurisdiction to remove protectors and the circumstances which justify the intervention of the courts.
