David Pickstone


David Pickstone, head of Stewarts’ tax litigation and investigations team, has acted in significant cases, from Prudential’s privilege litigation to the States of Jersey’s challenge on input VAT. He and his team have developed large class actions, including the Ingenious, Eclipse, Scotts Atlantic and Invicta 43 group actions, and acted for various well-known HNWs in individual tax disputes. The solicitor also acts for families, businesses and large corporates. Clients vary, but they all receive a tailored approach to their tax woes, with ‘practical and commercial advice’ to produce the best outcome.

Pickstone’s department is working on cases worth approximately half a billion pounds. Many of them are litigations raised from HMRC’s success in challenging tax avoidance schemes within the courts. ‘A number of our cases have the potential to change the way UK law is applied and are being watched by the market,’ he says.

‘We’re seeing more pressure from HMRC as it grapples to develop an appropriate tax system,’ Pickstone says. He believes Brexit will worsen the uncertainty for HNWs and businesses, so it is fortunate that his team has specialist knowledge on commercial disputes that evolve from tax issues.

Pickstone says the media’s tendency to ‘vilify’ HNWs linked with investments that have a tax element without explaining the technicalities of such affairs creates a landscape of unfairness. ‘The Eclipse 35 is the cardinal case in this matter and shows the injustice which can occur.’
