Jan Atkinson


Jan Atkinson cut her teeth as a property lawyer in the City before joining Osbornes Law in 1991. She has since honed specialisms in wills, estates and trusts, and now represents global clients in complex cross-border tax and succession issues and estate disputes, including construction and validity of wills, property and corporate conflicts and family company administration. Now a senior partner at the firm, heading up a 13-strong team, Atkinson’s niche practice focuses on wealth planning, high value estate administrations, international estates and disputed probate and trusts cases. The team’s high-quality work often has a strong international emphasis, dealing with cross-border estates, and is predicated on a combined wealth of experience in court appointed independent estate administrations.

Ranked in Chambers HNW directory, Atkinson has a formidable set of expertise, unravelling complex estate administrations with issues such as intervening deaths of beneficiaries and executors, as well as representing clients under the Inheritance Act 1975. She maintains a crucial interface with Osbornes’ family law department and property team, providing specialist tax, trusts and wealth planning assistance to clients in connection with their financial settlements on divorce and property transactions.

Atkinson is well-regarded in the field for her active presence in the private client legal community. Her role on the Law Society Private Client Section Executive Committee and her membership of the Society of Trust and Estate Practitioners and the Association of Contentious Trust and Probate Specialists mean her network is impeccable. She is also a registered Trust and Estate Practitioner and Contentious Trust and Probate Specialist, and writes and lectures on inheritance issues.

Atkinson’s cases involve ‘intricate estate administrations, international probate work, successful Inheritance Act claims and resolving disputed estates’. In one £12 million case, she advised a widow and the discretionary beneficiary of her entitlement under various will trusts and inter vivos trusts, assessing the work done in trust administration and advising on restructuring trusts options to benefit the widow. In a separate case valued at £8 million, Atkinson acted for the executor of the estate of a son embroiled in acrimonious divorce proceedings at the date of his death. ‘This meant an inappropriate will was in place and the discretionary trust arrangements in that will needed to be restructured to minimise IHT while reaching an agreement with the deceased’s estranged wife and ensuring appropriate provision for the three children,’ she says.
