Erica Shelton deals with all areas of family law, particularly complex ancillary relief cases, many involving international couples with offshore corporate, tax and trust structures, including claims after an overseas divorce. A partner with over 30 years’ experience, Shelton has had another busy year, with a high number of HNW divorces involving international couples, with complicated jurisdiction disputes, involving two or more countries.
Pre-nups, she says, are increasingly in demand, as an essential asset protection tool, amongst younger couples where one or both families want to protect generational wealth should divorce happen, as well as older couples wanting to preserve wealth for their children.
Divorce rates among the over 60s are rising. ‘People are now healthier, often still working in their 60s and, with rising life expectancy, they may decide they do not want to spend another 20 to 30 years with their spouse,’ Shelton explains. ‘That can be difficult for the spouse who has not made that decision.’
The work remains rewarding. Shelton, who has been involved in a number of high profile reported cases – including Conran and Judge – sees her role as ‘helping divorcing spouses through a time that’s difficult emotionally, and often legally and financially, and seeing them ready to get on with their lives at the end of the process’.
Described by observers as ‘very pleasant to deal with’, ‘sensible’ and ‘pragmatic’, she is also tough when necessary, and a good negotiator.
